This Rental Agreement (“Agreement”) is automatically agreed to by the customer when they make a purchase, rental, or create an account on Red Lake Rentals’ website (hereinafter referred to as “The Company”).
This Agreement is designed to protect both The Customer and Red Lake Rentals (hereinafter referred to as “The Company”).
1. PARTIES
The Company: Red Lake Rentals, a rental business located at 6 West Rahill Drive, Red Lake, ON P0V 2M0, hereinafter referred to as “The Company,” rents certain equipment to the person or persons referred to during the checkout process.
The Customer: The individual or entity referred to during the checkout process, hereinafter referred to as “The Customer.”
2. RATE OF RENTAL
The rate of rental is as displayed on the checkout page.
3. PERIOD OF RENTAL
The period of rental is as displayed on the checkout page.
4. LOADING, UNLOADING, AND TRANSPORTATION
The Customer is responsible for all costs incurred to transport the rented equipment from Red Lake Rentals’ warehouse and return it to the same location at the end of the rental period.
5. DELIVERY/MOBILIZATION FEE
a. Red Lake Rentals offers the option of delivering the equipment to the specified site for a mobilization fee. The amount of this fee will be communicated to The Customer during the checkout process and is subject to change based on location and equipment.
b. The mobilization fee covers the transportation of the equipment to the designated site. The Customer acknowledges and agrees to this additional charge, which will be included in the total rental cost.
c. Deliveries will only be made to locations accessible via MTO-maintained highways within the Municipality of Red Lake and the Township of Ear Falls. Any deliveries requested outside these boundaries are entirely at the renter’s risk, and The Customer will be responsible for arranging pickup and transportation of the equipment to and from such locations. Red Lake Rentals assumes no liability for any damage, delay, or issues arising from delivery or use of equipment outside the stated delivery area.
6. EQUIPMENT VALUE
It is agreed that the value of the equipment rented is of a fair market value.
7. EQUIPMENT RETURN
Notification to Red Lake Rentals of the availability of equipment for return will not be considered a return of the equipment, nor will it relieve The Customer of their responsibility for any loss or damage to the equipment.
8. OPERATION & MAINTENANCE
a. The Customer agrees not to alter, remove, or cover up any lettering, numbering, or company insignia displayed on the equipment. The Customer also agrees to employ only competent operators for the equipment, ensure that the equipment is not subjected to careless or rough usage, and store it in a weather-proof and secure location during the rental period.
b. Traveling on Dirt Roads: The Customer acknowledges that traveling on unpaved or dirt roads, including but not limited to Nungessor Road, can subject the rented equipment to additional wear and tear, potential damage, and increased risk of breakage. The Customer agrees that they are solely responsible for any damage to the equipment incurred while traveling on such roads. This includes, but is not limited to, damage to the windshield, undercarriage, and other components of the equipment. The Customer must inform Red Lake Rentals in advance if the equipment will be used on unpaved or dirt roads. Red Lake Rentals may, at its discretion, assess and document the condition of the equipment prior to rental and may impose additional fees or conditions to cover potential risks associated with such travel. Red Lake Rentals reserves the right to refuse any rental if the Customer’s travel plans include usage on unpaved or dirt roads. The Customer agrees to cover any repair costs and damages resulting from use on dirt roads, which will be assessed and charged accordingly. The Customer should ensure that any travel on unpaved or dirt roads is conducted cautiously and in accordance with safe operating practices to minimize the risk of damage to the equipment.
9. TITLE
Title to the rented equipment at all times vests in Red Lake Rentals unless transferred to The Customer through sale. The Customer shall keep the equipment free from any and all liens and claims and shall not allow Red Lake Rentals’ title to become encumbered or impaired.
10. TERMINATION OF AGREEMENT
Should The Customer default in payment, become bankrupt, or fail to maintain the equipment within the terms of this Agreement, Red Lake Rentals may terminate this Agreement, take possession of the equipment without becoming liable for trespass, and recover all rental due, along with all expenses incurred in recovering the equipment.

11. INSURANCE
a. The Customer may use the equipment in the conduct of their business, provided they are solely responsible for any loss or damage, irrespective of the cause, and are obligated to return the equipment in the same state received, allowing reasonable wear and tear.
b. The Customer is responsible for any loss or damage due to theft, fire, or accidents and must take prudent measures to maintain the equipment’s condition.
c. The Customer assures Red Lake Rentals that they have insurance covering the aforementioned loss or damage they might be responsible for under this Agreement.
d. The Customer must promptly notify Red Lake Rentals in writing of any loss or damage to the equipment.
12. LIABILITY
All liability arising from the operation, handling, or transportation of the rented equipment during the rental period shall be assumed by The Customer, and they shall indemnify Red Lake Rentals against all such liability.
We recommend that customers consider adding rental items to their general insurance for replacement value; however, this is not required, and most of our customers choose to pay for any damages directly to Red Lake Rentals.
13. CONDITION OF EQUIPMENT
Red Lake Rentals reserves the right to refuse to accept equipment returned in a damaged or dirty condition and to continue levying rental charges until the equipment is returned in an acceptable condition. Labor charges may be added to the final invoice if Red Lake Rentals is forced to clean equipment returned in a dirty condition.
14. FUEL OF RENTALS
All rentals must be returned to Red Lake Rentals with the same amount of fuel as they were sent out with. If The Customer does not fill up the equipment before returning it, Red Lake Rentals has the right to charge for fuel and labor on the final invoice.
15. RENTAL RETURN
The Customer agrees to return the rented equipment to Red Lake Rentals at the end of the rental period. The return must be made by 9:00 AM on the last day of the agreed-upon rental period. Failure to return the equipment by this time will result in an additional daily rate being charged until the equipment is returned.
16. CANCELLATIONS & REFUNDS
a. Cancellations: If The Customer wishes to cancel a reservation, they must notify Red Lake Rentals at least 48 hours prior to the scheduled rental start time. Cancellations made within this period may be eligible for a full or partial refund at the discretion of The Company.
b. Refunds: Refunds will not be issued for:
Equipment returned early.
Unused equipment.
Cancellations made less than 48 hours before the rental start time.
Equipment returned due to misuse or violation of this Agreement.
c. Customer Responsibility for Pickup Location: It is The Customer’s responsibility to be aware of Red Lake Rentals’ location prior to confirming a rental. No refunds will be issued for cancellations due to The Customer not realizing the location of the equipment or being unwilling/unable to travel to the pickup site.
Rental Definitions:
Daily rate is billed for a 24-hour session.
Weekly rate is billed for a session of 7 days.
Monthly rate is billed for a session of 4 weeks (28 days).
By making a purchase, rental, or creating an account with Red Lake Rentals, The Customer agrees to abide by the terms and conditions outlined in this Rental Agreement.
